These Terms of Service ("Terms") govern your access to and use of the "Kanapp" mobile application ("App") and related services (collectively, the "Service"), operated by KICHIEMON WORKS ("we", "us", or "our"). By downloading, installing, or using the App, you ("user") agree to be bound by these Terms.
1. Acceptance of Terms
- These Terms apply to all users of the Service.
- By accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms.
- Any supplemental guidelines, rules, or policies posted within the App or website ("Supplemental Terms") form an integral part of these Terms. In the event of a conflict, Supplemental Terms shall prevail.
2. Minors and Parental Consent
- If a minor or child uses the Service, such use must occur under the supervision and consent of a parent or legal guardian ("Parent").
- Parents are responsible for supervising their children's use of the App and for any purchases made under their Apple ID. The App incorporates a Parental Gate to prevent unintended purchases or external navigation.
3. Service Description & In-App Purchases
- Core features of the App (such as basic Hiragana tracing) are provided free of charge.
- We offer optional add-on character packs (Katakana, Numbers, Alphabet, Kanji, Hangul, etc.) and developer support items for purchase.
- Add-on character packs are provided strictly as one-time, non-consumable in-app purchases. Once purchased, you retain permanent access to the unlocked content under your Apple ID.
- The Service does NOT contain or require auto-renewing subscriptions or monthly recurring fees.
- You may restore your previously purchased content free of charge on new devices or after reinstalling the App by tapping the "Restore Purchases" button in the App settings.
4. Payment & Refund Policy
- All payments for in-app purchases are processed securely through Apple Inc. (App Store) using the payment methods linked to your Apple ID.
- Due to the nature of digital content, all completed purchases are final and non-refundable, except as required by applicable law or Apple's standard policies.
- If you request a refund under Apple's standard terms, you must submit your request directly to Apple Support. We abide by Apple's official refund decisions.
5. Intellectual Property Rights
- All intellectual property rights in the Service—including text, graphics, illustrations, voice recordings, software code, and visual design—belong to us or our licensors.
- Kanji stroke order framework data included in the App utilizes data licensed under the KanjiVG project (Creative Commons Attribution-ShareAlike 3.0 Unported License).
- We grant you a personal, non-exclusive, non-transferable, revocable license to use the App solely for private, non-commercial educational purposes.
6. Prohibited Activities
When using the Service, you agree not to:
- Violate any applicable laws, regulations, or third-party rights.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Exploit software bugs, glitches, or vulnerabilities for unauthorized gain.
- Copy, distribute, resell, or commercially exploit any content, audio, or graphics from the App without prior written permission.
- Interfere with or disrupt the integrity or performance of the Service or its servers.
- Impersonate any person or entity.
7. Modifications & Service Interruption
- We reserve the right to modify, update, or discontinue any feature of the Service at any time without prior notice.
- We may temporarily suspend or interrupt the Service in the event of system maintenance, technical failures, natural disasters, or other emergencies beyond our reasonable control.
- We shall not be liable for any losses or inconvenience caused by such modifications or temporary service suspensions.
8. Disclaimer of Warranties & Limitation of Liability
- THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR ABSOLUTELY SECURE, NOR DO WE PROMISE SPECIFIC EDUCATIONAL OUTCOMES.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
9. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which outlines our strict zero-personal-data collection policy for children's safety.
10. Amendments to Terms
We reserve the right to update these Terms at any time. Revised Terms become effective immediately upon posting on our website or inside the App. Continued use of the Service following posted changes constitutes acceptance of the new Terms.
11. Governing Law & Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
- Any legal dispute arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent court having jurisdiction over our principal place of business in Japan.
